Version 1.0 · Effective September 10, 2026

Terms of Service

These terms are the agreement between you and Oleksandr Pokariev ("we", "us") about your use of Pocket frAIday — the website at pocketfraiday.website, the companion app, the Telegram channel and the assistant itself (together, the "Service"). By creating an account you accept them. If you do not, do not create one.

§1Who may use the Service

  • You must be 18 or older. There is no younger tier; this is not a product for children.
  • You must be able to enter a binding contract where you live, and not be barred from receiving the Service by sanctions or local law.
  • Access is currently by invitation. An invitation is personal, single-use and not transferable.
  • One account is for one person. Do not share your login. The assistant builds a model of one person and a shared account corrupts both the experience and your privacy.

§2Your account

You are responsible for your credentials and for what happens under your account. Tell us at once if you think someone else has access.

Keep your email address current — it is how we reach you about the account, about security, and about changes to these terms.

You may sign in with a password or with Sign in with Apple. If you use Apple's private relay address, mail we send still reaches you through it; if you later disable forwarding at Apple, we cannot reach you.

§3What the assistant is, and what it is not

The assistant is software. It writes convincingly and it is wrong sometimes. Treat what it says as a capable draft, not as fact.

Specifically:

  • It is not a professional. Nothing it says is medical, legal, financial, tax or psychological advice, however confidently it is phrased. For anything that matters, ask a person who is qualified and liable.
  • It is not an emergency service. It can call your phone, but it cannot call an ambulance for you and must not be relied on when someone's safety is at stake. In an emergency call the emergency number where you are.
  • It is not a person, has no feelings and forms no relationship with legal meaning, whatever it sounds like — including in the adult mode.
  • It acts, and actions have consequences. See Section 4.

§4The assistant acting on your behalf

Pocket frAIday is not only a conversation. On your instruction the assistant can browse the web from a persistent browser profile that stays logged into your own accounts, read the mail you forward to it, write to your calendar, send messages in your Telegram, and call your phone.

That capability is the core of the product, so the agreement around it is explicit:

  • Every such action happens on your authority. You are asking for it, and you are responsible for the result, including anything it does inside your third-party accounts.
  • You keep the responsibility you already had to those third parties. If a site's own terms forbid automation, or forbid an agent logging in for you, that is between you and them, and asking our assistant to do it does not make it allowed.
  • Give it only the access you are willing to have used. A logged-in session in its browser profile is a session it can use. We strongly recommend not storing payment methods in the accounts you let it use, and reviewing anything with financial or legal effect before it happens.
  • We do not guarantee any particular action succeeds. Sites change, block automation, and demand human verification; the assistant will not defeat a CAPTCHA or a bot check for you and will not pretend it is a human when asked.
  • We are not a party to whatever you do at a third party through it, and we do not take on their obligations or yours.

§5Acceptable use

Do not use the Service to:

  • Break the law, or help anyone else do it;
  • Harm, harass, defraud, stalk, impersonate or expose another person;
  • Produce or seek sexual content involving minors, or content sexualising anyone who is not an adult — this is the one line whose crossing ends the account instantly, permanently, and with a report to authorities where required;
  • Create or distribute malware, break into systems, or scrape at a scale that degrades someone's service;
  • Circumvent our limits, quotas, gates or safety measures — including the age gate — or try to make the assistant do so on your behalf;
  • Hold more than one account to get more of a plan's limits. One account per person; on the same device, any further Free account shares the first one's Free limits;
  • Resell the Service, or run someone else's product on top of it, without our written agreement.
We may suspend an account immediately where we reasonably believe it is being used this way, and we will state why unless the law stops us.

§6Adult mode

An adult conversational mode exists on the website and in Telegram. It is off for every account until its owner opens it, which requires confirming they are 18 or older and consenting explicitly to that content and to its storage. The Adult Mode Addendum governs it and forms part of these terms once you enable it.

It does not exist in the mobile app, in any form, and it never will while the app stores' rules stand as they do.

§7Your content, our software

Yours stays yours. Your messages, your documents, your files, the assistant's memory of you — you own them. You grant us only the licence we need to operate the Service for you: to store that content, process it, and pass the part of it that is needed to the model and infrastructure providers listed in the Privacy Policy. That licence ends when your content is deleted.

We do not train models on your content, and we do not permit our providers to.

Ours stays ours: the software, the interface, the assistant's design, the prompts and the name are our intellectual property and these terms give you no rights in them beyond using the Service.

Anything the assistant writes for you is yours to use freely. Output of a language model may resemble output someone else was given; we make no claim of exclusivity in it, and we cannot promise it is free of third-party rights.

§8Availability

The Service is provided as it is, and it changes. We add and remove features, and we take the system down for maintenance. We do not promise any uptime figure and there is no SLA. We do our best, and we do not consider losing your data an acceptable outcome of any change.

§9Pilot period

While the Service is in its pilot phase:

Pilot accounts are on the full plan at no charge, and no payment method is required. The paid Early Birds plan (Section 10) is offered alongside the pilot to those who choose it;

Features may change, break or disappear at short notice;

The pilot may end, and paid plans may begin. We will tell you before that happens and you will not be charged without agreeing to a plan first;

Everything else in these terms applies in full, including Sections 5, 11 and 12.

§10Plans and payment

This section applies to paid plans. The first one, Early Birds, opened on September 24, 2026 as a monthly subscription with a limited number of places.

Plans, their prices and what each includes are shown on the pricing page before you subscribe. The seller is a private individual not registered for VAT, so no VAT is added and the price shown is the price you pay.

Subscriptions renew automatically for the same period until cancelled. You can cancel at any time; the plan then runs to the end of the paid period and stops.

Early Birds gives the features of the High plan for 30 days from your first payment. After those 30 days the subscription continues as the Lite plan at the same price, unless you choose High, move to Free or cancel. We remind you at least 7 days before the 30 days end.

We may change the price of a plan. For an existing subscription a new price is announced by email at least 30 days in advance and applies only from the first billing period that starts after that notice; until then you keep paying the old price, and you can cancel before the change without any charge.

Payment is processed by Stripe Payments Europe, Ltd. Card data goes to Stripe and does not reach us. You can cancel or change your card at any time from the billing page, which opens Stripe's own customer portal.

Right of withdrawal (EU/UK consumers): You have 14 days to withdraw from a purchase of digital services without giving a reason. Because the Service starts working immediately upon purchase, you will be asked to confirm that you want it to start and that you acknowledge losing the full right of withdrawal once service has been provided; where it is only partly provided you owe a proportionate amount.

§11Ending the agreement

You may delete your account at any time — Settings → Danger Zone on the web, or Settings → Account in the app. Deletion is irreversible after a 14-day window; Section 7 of the Privacy Policy specifies what is destroyed and what survives.

We may suspend or close an account for a serious or repeated breach of Section 5, for non-payment after notice, or if we stop offering the Service. Except where Section 5 requires immediate action, we give you advance notice and a chance to export your data.

§12Liability

Where you use the Service as a consumer, nothing in these terms limits liability that cannot be limited by law — death or personal injury caused by negligence, fraud, or intent.

Subject to that, and to the extent the law allows:

  • The Service is provided without warranties beyond those mandatory by law;
  • We are not liable for what the assistant gets wrong, for decisions you take on what it tells you, or for what happens in your third-party accounts when you have it act there;
  • We are not liable for indirect or consequential loss, lost profit, lost opportunity or lost data beyond what our own fault caused;
  • Our total liability for any claim is limited to what you paid us in the 12 months before it arose — and where you paid nothing, to EUR 100.

§13Governing law and jurisdiction

These terms are governed by the law of Poland, without prejudice to mandatory consumer protection laws in the jurisdiction where you reside.

Disputes shall be submitted to the competent courts of Poland; as a consumer you may also bring claims in the courts of your country of residence.

We will change these terms from time to time. Material changes are announced by email or in the app at least 14 days before they take effect, and continuing to use the Service after that means accepting them. If you do not accept, delete your account.

If any clause turns out to be unenforceable, the rest of these terms remains in full effect.
